A Delay Is Simple as Being Late for Any Reason
Video Transcribed: Construction attorney, Brian Carter with tulsaconstructionlawyer.com. And this video, I’m going to talk about what the difference is between a delay and a disruption and what that can look like to a construction project.
A delay is simple as being late for whatever reason. And usually the remedy for a delay is additional time, depending on obviously the circumstances behind the delay.
However, a disruption is a deviation from the planned method or contracted methods of work, which result in inefficiencies and ultimately greater expense to the project.
Oftentimes this is something that is out of the control of the contractor experiencing the disruption and that results in a claim for additional compensation, which is often measured by looking at how the work was originally planned versus what was actually utilized, the methods utilized and resulting difference in costs to base a claim for a disruption.
And again, delays can cause disruptions and disruptions can cause delays so they’re very intertwined and it’s a circular dynamic there with the two.
But again, a delay is just simply being late whereas a disruption is a deviation from the planned working methods and resulting in inefficiencies and additional cost to the project. Again, Brian Carter with tulsaconstructionlawyer.com. Thank you.
