Video Transcribed: Tulsa Attorney Brian Carter here, with TulsaConstructionLawyer.com. And in this video, I’m going to go over some of the common areas for disputes involving a construction project.
Disputes can come from a multitude of areas including design, permitting, construction, and supply of services and materials to a given project, disputes over the scope of work, or plans, and specifications, which usually involve interpretation of work or plans and specifications as well, as to the scope of work to be performed.
Also, scope issues between the contractor and subcontractors and sub-subcontractors. And that, usually, is a result of documents not being as detailed as they need to be, outlining everyone’s responsibilities to a project.
Other areas of dispute can be accidents and injuries on a project, general negligence, contract issues, breach of contract. There’s a whole host of contract issues that I will get into in subsequent videos. Breaches of warranty, whether express or implied.
I mentioned material deficiencies or defects, areas involving strict liability when the contractor is responsible, regardless who is at fault. A good example of this is inherently dangerous practices like using explosives.
